Time and Space Intensive Driving Schools - Terms and Conditions
48 hours notice of re-arrangement or cancellation is required to avoid loss of fee.
The contract of driving lessons is between the student and the instructor who is either a self-employed franchisee of Time and Space Driving Schools or a self employed independent instructor working with the Company on an agency basis. Any dispute, claim or discussion should therefore be taken up with the instructor and not with Time and Space Driving Schools. The company cannot be held liable for any compensation claim from either instructor or student, nor can it be held responsible for any traffic law violation on the part of either instructor or the student.
In the unlikely event of an instructor being deemed unsatisfactory, an alternative will always be offered by the company. Should this be refused the minimum deposit for an intensive course will be retained. Additional money paid by way of an intensive course balance or an advance block booking payment for weekly lessons will be returned at the discretion of the instructor (less any work already done and an administration fee).
Intensive courses must start within 6 months of payment of the deposit. The driving test fee will be lost if the test has not been booked within 3 months following the start of the course. If a deposit is taken for an intensive course the balance of the total fee will be paid on commencement of the course, although for experienced learners who may not need 20 hour, the payment may be made on a pay as you go basis. This will be at a reduced rate any overpayment at the end of the course being made by the company directly from the original deposit. The deposit is not refundable but may be held for 6 months if the course is not taken up immediately.
The company cannot guarantee that test standard will be achieved by the end of 20 hours and this is especially the case for a beginner. Fees for additional training following an intensive course are subject to the instructor’s discretion but may be charged at the same rate as the course and this also applies to training and the duration of the test on test day. The deposit secures a contract between pupil and instructor that a 20 hour intensive course will take place usually over one or two weeks. In exceptional circumstances this may be extended to no more than three weeks by mutual agreement. Should the client decide not to complete the intensive course, any refund for hours not completed will be made at the instructor’s discretion. The deposit remains non-refundable. Should an intensive course not be taken up immediately, either at the wish of the customer or following the advice of the instructor, lessons discontinued and/or contact lost for more than 6 months; the intensive course deposit will be lost. In addition The Company reserve the right to cancel the driving test and under the above circumstances the test fee will remain non-refundable. Experienced learners may require less than 20 hours by the time the test is taken, thus part payment may be made at the pro-rata rate or a refund given by mutual agreement but also see above. The client will pay for any further driving tests if necessary. In the event of a price rise, the fee at the time the booking deposit is paid will apply provided the course is taken within 2 months. Therefore if a fee is advertised and advised then changed prior to the deposit payment, or if the course is left longer than 2 months, the new fee will apply. The balance of the fee must be paid to the instructor at the start of the intensive course, however a part balance may be accepted at the discretion of the instructor in the case of an experienced learner. The test fee includes a payment for a standard practical test fee (presently 62 GBP, 2009).
If a booking is made for an assessment lesson prior to an intensive course and, as a result, the customer requests a different instructor. Time and Space Driving Schools cannot guarantee to honour the hours originally requested by the customer.
If contacted with short notice, or call from certain locations, we will provide from an associate company.
The instructor is a highly trained professional and will advise the student as to when they should apply for the driving test. In the interest of road safety, the instructor’s vehicle may be withdrawn from the test if, at the discretion of the instructor, the student is considered unsafe, sufficient hours have not been completed or a recommended number of hours is refused. The company may cancel the test should this be booked on the condition of a number of recommended hours which is then refused. The instructor’s vehicle is available for the driving test only at the discretion of the instructor and subject to regular lessons being maintained.
Time and Space Driving Schools cannot be held responsible for the loss of test fee due to bad weather, illness of the examiner or failure of the instructor to provide a roadworthy vehicle. Following the driving test, the instructor will drive the student back from the test centre whether or not the student has passed.
The company reserves the right to amend these terms and conditions at any time and an updated version will be maintained on the company web site.
